1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Lindo & Baxter Logistics website, booking tools, and client portal, and any delivery services you request from Lindo & Baxter Logistics ("Lindo & Baxter," "we," "us," or "our"). By requesting a quote, booking a delivery, creating a client portal account, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Description of Services
Lindo & Baxter Logistics provides same-day courier and delivery services across Boston, Cambridge, and the greater Massachusetts area, including:
- Same-Day Delivery
- Rush Delivery (2–3 hour priority handling)
- Door-to-Door Delivery
- Local Courier Services
- Business Logistics (dedicated drivers, fixed routes, monthly invoicing)
- Scheduled and recurring deliveries
Service availability, response times, and coverage areas are subject to driver availability, weather, traffic, and other conditions outside our control.
3. Booking and Scheduling
Deliveries may be booked through our website or client portal. You are responsible for providing accurate pickup and dropoff addresses, contact information, and a complete and accurate description of the item(s) being shipped. We are not responsible for delivery delays or failures caused by inaccurate or incomplete information you provide.
Same-day and rush deliveries are subject to same-day driver availability. While we target the response and delivery windows advertised on our website (for example, 30-minute response time and 2–3 hour rush delivery), these are targets, not guarantees, and actual times may vary with conditions outside our control.
4. Pricing and Payment
Pricing is based on service type and distance, as published on our website and subject to change. Massachusetts state sales tax (currently 6.25%) applies to all deliveries. Additional fees may apply for extra stops, waiting time, late-night delivery, heavy item handling, or holiday delivery, as disclosed at the time of booking.
Payment is due at the time of booking for individual deliveries, unless you hold a Business account with agreed monthly invoicing terms. Business account invoices are due within [number of days] days of the invoice date. Late payments may be subject to a late fee of [amount or percentage].
5. Cancellations
You may cancel a scheduled delivery before a driver is dispatched for a full refund. Once a driver has been dispatched or pickup has occurred, cancellation fees may apply as follows: [describe your cancellation fee structure, e.g., “a $10 dispatch fee applies once a driver has been assigned”]. Same-day and rush bookings may not be cancellable once accepted, given the compressed delivery window.
6. Prohibited Items
You may not ship the following through Lindo & Baxter Logistics:
- Illegal substances or items whose transport violates federal, state, or local law
- Firearms, ammunition, or explosives
- Hazardous, flammable, corrosive, or radioactive materials
- Cash, currency, or negotiable financial instruments
- Live animals
- Human remains or body parts
- Any item that is improperly packaged for safe transport
We reserve the right to refuse, inspect, or return any shipment we reasonably believe violates this section.
7. Insurance and Liability
All deliveries include basic insurance coverage as described on our website at the time of booking. Our liability for loss or damage to a shipment is limited to [e.g., “the declared value of the item, up to a maximum of $X, unless additional insurance was purchased at booking”]. We are not liable for delays, loss, or damage caused by circumstances beyond our reasonable control, including weather, traffic, road closures, or acts of third parties.
You are responsible for accurately declaring the value and contents of any shipment. Additional insurance coverage may be available for higher-value items; contact us for details before booking.
8. Client Responsibilities
You agree to:
- Provide accurate pickup, dropoff, and contact information
- Ensure someone is available to release the package at pickup and receive it at dropoff, or provide clear delivery instructions if not
- Properly package items to withstand normal handling during transport
- Not ship any prohibited item listed in Section 6
9. Client Portal Accounts
If you create a client portal account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at (617) 755-3024 if you suspect unauthorized use of your account.
10. Business Accounts
Business Logistics customers receive services under the terms agreed in their individual business agreement or Service Level Agreement (SLA), which supplements these Terms. Where a specific business agreement conflicts with these Terms, the business agreement controls for that account.
11. Disclaimer of Warranties
Our services are provided “as is” and “as available.” Except as expressly stated in these Terms, we make no warranties, express or implied, regarding the services, including any implied warranty of merchantability or fitness for a particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, Lindo & Baxter Logistics is not liable for indirect, incidental, special, or consequential damages arising from the use of our services, including lost profits or lost business opportunities, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a delivery is limited as described in Section 7.
13. Indemnification
You agree to indemnify and hold harmless Lindo & Baxter Logistics, its drivers, and employees from any claims, damages, or expenses arising from your breach of these Terms, your violation of applicable law, or your shipment of a prohibited item.
14. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any dispute arising from these Terms or our services will be resolved in the state or federal courts located in Massachusetts, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a revised “Last updated” date. Continued use of our services after a change constitutes acceptance of the updated Terms.
